Kathy Constan LLB, BA
Kathy Constan founded Hercules Constan in 1993. She was admitted to practice law in 1989 and holds a following law degree from the University of Melbourne.
In her 30 year career, Kathy has specialised in litigation and commercial law. She has representied Statutory Authorities, corporations, large and small privately owned businesses and private individuals.
Kathy has an in depth understanding of the water industry and the Water Act (Vic) 1989 gained through representing the water authorities for over 25 years. She has developed and implemented many innovations to improve the outcomes for her water clients, including cost effective recovery solutions,alternative collection strategies and caveats. She has successfully prosecuted individuals and corporations for breaches of the Water Act 1989 including theft of water, dumping of waste into sewers. In addition she has litigated and resolved substantial claims for damages to infrastructure as a result of construction works. Kathy has been engaged by all three water retailers to provide advice as to collection of accounts within the legislative framework and has been a contributor to the Water Reform Commission .
Kathy also has a significant practice inthe area of commercial law with a particular focus on Pharmacy transactions. She has represented both Vendors and Purchasers in both sales and purchases of businesses up to $20M. These matters have ranged from transactional through to complex transactions involving multiple buisnesses, restructuring, options, management agreements and property interests including leasing and licensing.
Kathy believes in clear and pragmatic advice. She strives to ensure that her client fully understand the legal process and explore a range of options for the best outcome.
Kathy enjoys travelling, food, skiing and spending time with her family. She is also fluent in the Greek language.
